Terms of Use

 

Please read these terms of use carefully before using the www.tbmcouncil.org website (the “TBMC Site” the “Site” or “Web Site”). Using the Site indicates you accept these terms (the “Terms”). If you do not accept these Terms, please do not use this Site. In addition to the Terms, you may also be subject to other agreements, for example, TBM Council Members are also bound by a separate membership agreement, and Apptio customers are subject to their commercial customer agreement with Apptio. These Terms govern in the case of a conflict between the Terms and any such other Agreement, particularly with respect to contributions of content submitted via this Site. In some cases, downloading certain material or access to certain portions of the Site may require agreeing to additional terms or registration. For example, if you choose to download and use the TBM Book you will likely need to register as a member of the TBM Council and your use of the TBM Book will be governed by these Terms, the terms of your TBM Council membership agreement, and the End-User License Agreement associated with the TBM Book.

Copyright
The entire contents of this Site are protected by the United States copyright laws. Certain content is provided by Apptio, Inc. (“Apptio”) and other content is provided by the TBM Council (“The Council” collectively the “TBM Entities”) and as between you and the TBM Entities, the TBM Entities are the owner or licensee of the copyright and reserves the right to license or sub-license the contents of the Site, including any material created for the Site, at its discretion. The TBM Entities authorizes you to view and to use the materials at this Site only for internal and non-commercial use, provided that you retain this copyright notice on any copies of the materials that you use and subject to any other terms or conditions applicable to such content. Except as provided by the TBM Entities, you may not modify the materials at this Site in any way or reproduce or publicly display, perform, distribute, or otherwise use the materials for purposes that are competitive with the TBM Entities, or otherwise for a commercial purpose. For the purposes of these Terms, any use of these materials on any other web site or networked computer environment for any purpose is prohibited.

Material Submitted To the TBM Council Site & Member Contributions

Except as otherwise set forth in the applicable Privacy Policy, any materials, information, or other communication that you transmit or post to this Site ("Communication") will be considered non-confidential and non-proprietary, and The TBM Entities and its designees will be free to copy, disclose, distribute, incorporate, and otherwise use the Communication and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes.

 

If you are also a TBM Council member, you are subject to the following additional provisions regarding contributions in your role as a member of the community. You are not expected to provide any materials to the TBM Council as a general member, but you may voluntarily do so from time to time. Your “contributions” means such past, present, and future contributions, whether in written or in oral form that may include text, images, recordings, videos and any documentation, submitted voluntarily by you in any manner to the TBM Council. The TBM Council may use, or license others to use, the Contributions in any manner whatsoever, at any time, and in any and all media now known or hereafter invented, including but not limited to print, broadcasting, and online media without compensation or a duty to account. Further, if you voluntarily participate in any filmed or recorded session while participating with the Council you grant the Council right and permission to photograph, film, record and portray your name, voice, actions, and likeness, and to modify, edit, use, and reproduce all resulting works. In the instance of a conflict between this paragraph and the terms of your membership agreement with the TBM Council, the terms of your membership agreement will control.

 

Portions of the Site allow messaging and sharing of information in many ways, such as your profile. Information and content that you share or post may be seen by other members or, if public, by visitors. Where we have made settings available, we will honor the choices you make about who can see content or information. We are not obligated to publish any information or content on our Site and can remove it in our sole discretion, with or without notice.

From time to time, you may see links to third party websites. Links to third party web sites on this Site are provided solely as a convenience to you. If you use these links, you will leave this Site. As a general rule, the TBM Entities have not reviewed all of these third party sites and do not control and are not responsible for any of these sites or their content. The TBM Entities do not endorse or make any representations about these third party sites, or any advertising, information, software, or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of the third party sites linked to this Site, you do so entirely at your own risk.

Linking to the Site
You may wish to link to the Site and you may link only to the home page of this Site. Any other links may only be made with permission from the TBM Council. In all cases, neither your site nor your link to this Site (a) shall imply the TBM Entity’s sponsorship or endorsement of your site or the products, services, or materials promoted or set forth on your site; (b) shall contain republished, redistributed, or copied materials from this Site, including by framing or other means; or (c) shall misrepresent the relationship with the TBM Entity or this Site or contain any false, misleading, or derogatory information about the TBM Entity, its mandate, or services, or that of its partners or sponsors.

The materials and services provided at this site are provided "as is" without warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose. The TBM Entities further do not warrant the accuracy and completeness of the materials or services at this Site. Limitation of Liability

The Technology Business Management Council, Ltd. ("TBM Council" or "we") respects data privacy and is committed to protecting it through our compliance with this privacy policy ("Policy"). If you have questions or concerns regarding this Policy, you should first contact TBM Council using the following email address: privacy@tbmcouncil.org. If you do not receive acknowledgement of your inquiry or your inquiry has not been satisfactorily addressed, you should contact TRUSTe here. TRUSTe will then serve as a liaison with us to resolve any concerns you may have.

 

Scope

In this Policy, we provide information about the collection and use of personal information on our publicly available websites, including www.tbmcouncil.org and www.tbmconnect.org (collectively, our "Website") or otherwise by TBM Council in connection with its affiliate, partner, sponsor, and vendor relationships and including with respect to its founding sponsor and technical advisor, Apptio, Inc. (“Apptio”). This Policy does not apply to information collected from our employees, which are governed by other policies, or any information collected on any third-party site or by any third-party application that may link to or be accessible from the Website or other services.

 

By accessing and continuing to use the Website you signify your consent to the terms and conditions of our Policy. We may change or update this Policy from time to time (see Changes to our Policy) and your continued use of the Website is deemed to be acceptance of such changes. Please periodically check the Policy for updates and changes. If the local law that governs your personal information requires a more affirmative notice and consent to modify these terms, then any modifications of this policy will only apply to you if and to the extent the notice and consent regime requisite under such applicable law is observed.

 

EU and Swiss Safe Harbor

TBM Council complies with the U.S.-EU and U.S.-Swiss Safe Harbor frameworks as set forth by the United States Department of Commerce regarding the collection, use, and retention of data from the European Union or Switzerland. Upon request and within 30 days, TBM Council will grant individuals reasonable access to personal information governed by these frameworks that TBM Council holds about them via its Website. With respect to information gathered through the Website, TBM Council will take reasonable steps to permit individuals to correct, amend, or delete information which is inaccurate, out-of-date, irrelevant, incomplete or misleading if you request us to do so. Please contact support@tbmcouncil.org to request the correction of your personal information gathered on the Website.

 

Complaint Handling

As part of our participation in the Safe Harbor program, we have agreed to use TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Frameworks and this Privacy Policy. If you have any complaints regarding our compliance with this Privacy Policy or the Safe Harbor Frameworks you should first contact us at privacy@tbmcouncil.org. If contacting us does not resolve your complaint, you may raise your complaint with TRUSTe by Internet at <http://watchdog.truste.com/pvr.php?page=complaint&url=, fax at 415-520-3420, or mail at Watchdog Complaints, TRUSTe, 55 2nd Street 2nd Floor, San Francisco, CA, USA 94105. If you are faxing or mailing TRUSTe to lodge a complaint, you must include the following information: the name of company, the alleged privacy violation, your contact information, and whether you would like the particulars of your complaint shared with the company. For information about TRUSTe or the operation of TRUSTe's dispute resolution process, see http://watchdog.truste.com/pvr.php?page=complaint&url= or request this information from TRUSTe at any of the addresses listed above. The TRUSTe dispute resolution process shall be conducted in English. If you are unhappy with our handling of your complaint, you may also be able to refer the matter to the relevant privacy regulator in your jurisdiction.

 

Information We Receive

Website Visitor Information. We receive information from and about visitors to our Website, including:

  • When you submit requests or inquiries on our Website. Examples of activities include viewing content (e.g. whitepapers, publications, knowledge articles, best practices and other digital content), completing surveys, and requesting additional information, services, or support from us.
  • When you post materials on our Website. Examples of activities include uploading information about generally used custom reports, sharing models, discussion about taxonomy standards that you’ve had experience with, etc.
  • In connection with these activities, we may collect various information, such as your name, title, company name, address, phone number, and e-mail address, practices, and certain company information.
  • When you correspond with us via email.

 

Information we receive from third party business partners.

  • If you use a bulletin board or chat room on our Website, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums. We are not responsible for third party use of the personally identifiable information you choose to submit in these forums.
  • Like many websites, we use "cookies" to collect visitor information. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser. They make it possible for us to recognize your browser when you visit and to tell us whether customers and visitors have visited the Website previously. Member and Partner Relationship Information. We collect information from our members and prospective members, vendors and prospective vendors, partners and prospective partners including:

  • We require members who register to become members of the TBM Council to provide contact information, such as their name, company name, phone number, and e-mail address, and we may also ask for additional information such as title, department name, fax number, and additional company information, such as mailing address, annual revenues, number of employees, or industry (“Account Information”). Registered users can update or remove their account information at any time by logging into Website and editing their account information.
  • Prospective members often volunteer contact information to us so that we may continue to provide them with information about the TBM Council.
  • Registered users are required to provide an email address when registering for membership on the TBM Council, in order to receive a username and password. Users are responsible for maintaining the confidentiality and security of their user registration and password.
  • Vendors and Partners may also provide personal information about their employees in the form of contact information or other such information to us for purposes of the vendor’s services to TBM Council or in furtherance of the relevant partner relationship.
  • Members who often interact on forums and portal pages share with their peers information about their usage of technology, knowledge of best practice, advocate processes, and champion methodology. The information shared may be in the form of questions, answers, documents, blog posts, videos, podcasts votes and comments. Testimonials. We may post testimonials on our Website which may contain personally identifiable information such as the member’s name. We do obtain the member’s consent prior to posting the testimonial to post their name along with their testimonial. If you want to remove your personal information that is being displayed on our Website under public pages please send your request to privacy@tbmcouncil.org.

 

Uses of the Personal Information We Receive or Collect

  • We may use and disclose the information governed by this Privacy Policy that we collect about you or that you provide to us, including any personal information, in the following ways:
  • To provide you with information about the TBM Council and our events, services and partners. If we received your contact information directly, including from a subsidiary or related company, or if given the context of your provision of information you could have had a reasonable expectation that you would receive communications from us, then we may email you information regarding TBM Council events and affairs, and may send a newsletter type of communication via email which you can opt out of receiving such communications by using the "unsubscribe" link at the bottom of such email and/or by changing the notifications settings for your account on the Website
  • To diagnose and resolve issues with and otherwise improve our Website or services.
  • To carry out our obligations and enforce our rights arising from any agreements between you and us.
  • To monitor and track usage patterns on the Website.
  • To notify you of changes to our Website.
  • We may share your personal information with our founding sponsor and technical advisor, Apptio, Inc., which may, if given the context of your provision of information you could have had a reasonable expectation that you would receive communications from Apptio, email you information regarding technology business management, including Apptio’s products, services, and events, and may send you communications, including a newsletter type of communication, via email which you can opt out of receiving such communications by using the "unsubscribe" link at the bottom of such email and/or by changing the notification settings for your account on the website
  • In connection with prospective service engagements, partnerships or vendor relationships where the disclosing party is a prospective partner or vendor to the TBM Council.
  • You can choose not to provide us with your personal information, but if you do not provide us with your personal information when we request it, we may not be able to provide you with our full range of services, or provide a service appropriately tailored to you.

 

Our Disclosure Policy

TBM Council will not rent, sell, or share personal information about you with third parties or nonaffiliated companies for their promotional purposes without your permission. We may disclose personal information that you provide in furtherance of the purpose for which they were disclosed, providing the services that you have requested, when we otherwise have your permission, or under the following circumstances:

 

  • To our employees, affiliates, or subsidiaries. Our employees, affiliates and subsidiaries are located in North America, Europe, and parts of Asia, including the US, Canada, UK, Germany, Denmark, the Netherlands, and Australia. Please contact privacy@tbmcouncil.org for the current list.
  • To our founding sponsor and technical advisor, Apptio, Inc., in connection with its efforts to manage the operations of the TBM Council, as well as in connection with Apptio’s own business affairs, including with respect to its efforts to market and deliver technology business management products and services. If you would like additional information regarding Apptio’s involvement with the TBM Council, please contact info@tmbcouncil.org.
  • To our contractors in support of TBM Council affairs. These contractors are located in the US, the Netherlands, Germany, Australia, UK and India; however, please contact privacy@tbmcoucil.org for the current list, or
  • If TBM Council is acquired by, reorganized or merged with another company. In such an event, you will have the opportunity to ask not to receive promotional information following any such change of control. We may also disclose your personal information to third parties if:
  • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of TBM Council's Terms of Use, or as otherwise required by law.
  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. Choices About How We Use and Disclose Your Information We seek to provide you with choices regarding the personal information you provide to us. The following describes the choices you have:
  • Cookies. If you do not want us to collect cookies on the Website, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of our Website may then be unavailable or not function properly.
  • Offers from TBM Council. If you do not wish to have your e-mail address used for promotional purposes by the TBM Council, you can opt-out by sending an email to unsubscribe@tbmcouncil.org. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions.
  • Notifications from TBM Connect: If you do not wish to be notified via email any messages that are sent from TBM Connect to inform you of updates to discussion threads that you follow, comments on your posts, a weekly roundup of activity on the portal, etc., you may change the notification settings of your account defined under general preferences on the Website.
  • Review this Policy carefully. If you do not agree with our practices, your ultimate choice is not to use the Website. By using any part of the Website, you accept and agree to our Policy and to our practices. If we update this Policy, your continued use of the Website (following the posting of the revised policy) means that you accept and agree to the terms of the revised Policy.

 

Access to Your Account Information and Updating Information

You have the right and ability to edit your account information, at any time. Registered users can update or remove their account information at any time by logging into the Site and editing their account information. You can also opt in or out of receiving future communications of special offers and new product information by sending us an email at unsubscribe@tbmcouncil.org, or you can unsubscribe by following instructions contained in the messages you receive. We do reserve the right to send you certain communications relating to the Website, such as service announcements and administrative messages, that are considered part of your account membership, and we do not offer you the opportunity to opt-out of receiving those messages.

We will respond to any request for access to, correction or update of personal information within 30 days of the date of such request.

 

Data Security Overview

The goal of the TBM Council Information Security team is to protect the confidentiality, integrity and availability of data. We take reasonable steps to protect your personal data from loss, misuse, interference, unauthorized access, disclosure, alteration, and destruction. However, the security of information transmitted through the Internet can never be guaranteed and is not entirely within our control. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. In order to protect you and your data, TBM Council may suspend your use of a Website or service, without notice, pending an investigation, if any breach of security is suspected.
